Terms and Conditions

These Terms & Conditions govern the use of the Veld-Leaf website, sponsorship platform, preference selection system, educational content, appreciation gifts, deliveries and related services.

1. Introduction

By accessing the Veld-Leaf website, creating a profile, making a sponsorship contribution, submitting preference selections, receiving any appreciation gift, or interacting with Veld-Leaf in any way, you confirm that you have read, understood and agreed to these Terms & Conditions.
If you do not agree with these Terms, you must not use the website, make a sponsorship contribution, submit a preference selection or participate in the Veld-Leaf sponsorship programme.
These Terms must be read together with the Veld-Leaf Privacy Policy, Disclaimer, Delivery Policy, Returns Policy and any written agreement signed by Veld-Leaf and the Member.

3. Eligibility and Age Restriction

You must be 18 years or older to use the Veld-Leaf platform, make a sponsorship contribution, submit any preference selection, receive any age-restricted item or participate in any Veld-Leaf member process.

• you are at least 18 years old;
• all information provided by you is true, accurate and complete;
• you are legally permitted to participate;
• you will not allow a minor to access, receive, use or benefit from any age-restricted item; and
• you accept responsibility for your own lawful and responsible participation.

Veld-Leaf may request proof of identity, age, address, eligibility or lawful status at any time. Failure to provide satisfactory verification may result in refusal, cancellation, refund, suspension or termination.

4. Website Use

You may use the website only for lawful, private and responsible purposes. You may not use the website in any manner that damages Veld-Leaf, harms other users, breaches applicable law, compromises security, misuses the sponsorship programme or interferes with the operation of the platform.

• attempt unauthorised access to the website, member accounts or systems;
• copy, scrape or harvest website content without written consent;
• upload malicious code, viruses or harmful material;
• misrepresent your identity or eligibility;
• bypass age verification or payment controls;
• use the platform for resale, redistribution or unlawful supply; or
• place Veld-Leaf, its directors, suppliers, courier partners or members at legal, financial or reputational risk.

5. Sponsorship Model

Veld-Leaf operates as a sponsorship-based lifestyle and educational platform. Members may select a sponsorship contribution amount and, where available, submit preference selections within the applicable Preference Allowance.
A sponsorship contribution supports the Veld-Leaf platform and does not automatically guarantee any specific item, strain, variant, quantity, outcome, health benefit, allocation or delivery unless confirmed by Veld-Leaf and permitted by law.
Veld-Leaf may decline, amend, delay, substitute, refund or cancel any preference selection where fulfilment may be unlawful, unavailable, impractical, unsafe, restricted by a third-party provider, or inconsistent with these Terms.

6. Preference Allowance and Preference Selection

The website may allow Members to select Preference Items up to the available Preference Allowance linked to their sponsorship contribution. Preference Items may carry internal allocation values for purposes of managing the programme.
Members may be permitted to select multiple quantities of the same Preference Item, provided the total selection remains within the Member’s Preference Allowance and stock is available.
If the selection exceeds the available Preference Allowance, the Member may be required to adjust the selection or increase the sponsorship contribution. Veld-Leaf may disable selections, cancel excess selections, substitute items or contact the Member to resolve the issue.

7. No Unlawful Sale, Supply or Dealing

Nothing on the website may be interpreted as an offer to unlawfully sell, supply, distribute, deal in, transport, facilitate or commercially trade in any regulated or prohibited item.
Veld-Leaf will not knowingly process, fulfil, facilitate or complete any arrangement that would constitute unlawful dealing, unlawful supply, unlawful distribution, unlawful possession or any other unlawful conduct under South African law.
If Veld-Leaf reasonably believes that a Member intends to misuse the platform, resell items, supply minors, redistribute items, misrepresent the purpose of participation or create legal risk, Veld-Leaf may immediately suspend or terminate the profile and cancel any pending preference selection.

8. Regulated and Restricted Items

Certain Preference Items may be regulated, restricted, age-controlled, sensitive, courier-restricted or subject to additional legal compliance requirements. Veld-Leaf may require additional verification, documentation or confirmation before accepting, processing or fulfilling any selection involving a Regulated Item.
Veld-Leaf reserves the right to refuse, delay, restrict, substitute or cancel any Regulated Item selection where fulfilment may conflict with applicable law, legal advice, courier requirements, payment-provider terms, supplier restrictions, safety considerations or operational policy.

9. Member Responsibilities

Members are responsible for ensuring that their participation is lawful, private, responsible and appropriate. Members agree that they will not:

• provide false or incomplete information;
• allow a minor to access, receive or use any age-restricted item;
• resell, redistribute or unlawfully supply any Preference Item;
• use any item in public where prohibited;
• drive, operate machinery or perform unsafe activities while impaired;
• breach employment rules, property rules, housing rules or any applicable law;
• store or use any item irresponsibly or unsafely; or
• hold Veld-Leaf responsible for misuse after delivery or collection.

10. Contributions, Payments and Errors

All sponsorship contributions must be made in South African Rand unless otherwise expressly agreed in writing. A contribution is only confirmed once payment has cleared successfully and Veld-Leaf has accepted the contribution.
Veld-Leaf may use third-party payment service providers to process payments. Members may also be subject to the payment provider’s terms, privacy practices, verification requirements and transaction rules.
No credit facility is provided unless expressly agreed to in writing by Veld-Leaf and the Member. Veld-Leaf may correct contribution, allocation, stock, pricing, website, payment or technical errors at any time. If an error affects a Member, Veld-Leaf may offer correction, substitution, adjustment, cancellation or refund where appropriate.

11. Availability, Variants and Substitution

All Preference Items are subject to availability. Veld-Leaf does not guarantee that any specific item, strain, variant, quantity, flavour, colour, design, batch, size or category will always be available.
Where an item is unavailable, Veld-Leaf may offer a suitable alternative within the Member’s available Preference Allowance, request a revised selection, issue a credit allocation or process a refund where applicable.
Natural, plant-based, batch-based, handmade or supplier-provided items may vary in appearance, size, texture, aroma, colour, packaging, batch characteristics and availability.

12. Delivery and Collection

Delivery may be facilitated through third-party courier partners, including The Courier Guy or other providers integrated into the Veld-Leaf platform. Courier services are subject to the courier’s own operational rules, service areas, delivery times, verification requirements and restrictions.
Delivery timeframes are estimates and may be affected by stock availability, courier delays, verification delays, payment delays, weather, public holidays, loadshedding, supplier delays, incorrect address details or circumstances beyond Veld-Leaf’s reasonable control.
Members must provide accurate delivery details and ensure that an eligible adult is available to receive the delivery. Veld-Leaf is not responsible for failed, delayed or returned delivery caused by incorrect details, failed verification, Member unavailability or courier restrictions.
Additional courier or handling fees may apply where a delivery is missed, refused, returned, re-routed or re-attempted due to Member fault or failed verification.

13. Returns, Refunds and Cancellations

Veld-Leaf will comply with applicable South African consumer protection and electronic transaction laws. A Member may request cancellation, refund, replacement or correction where required by law, including where an item is defective, unsafe, incorrectly supplied, damaged on arrival or materially different from what was confirmed.
Due to the nature of certain items, Veld-Leaf may refuse returns for items that are opened, used, consumed, tampered with, damaged after delivery, unsealed, handled in a way that affects safety or hygiene, personalised, perishable, regulated or unsuitable for lawful return.
This does not limit any statutory rights that a Member may have in respect of defective, unsafe or incorrectly supplied goods. Approved refunds will be processed using the original payment method where reasonably possible. Full Refund and Return Policy

14. Defective, Damaged or Incorrect Items

If a Member receives an incorrect, damaged or defective item, the Member must notify Veld-Leaf as soon as reasonably possible, preferably within 48 hours of delivery, and provide supporting photographs or information where requested.
Veld-Leaf may require inspection or return of the item before approving a replacement, refund, credit or correction. Items damaged through misuse, improper storage, negligence, unlawful use or unauthorised modification will not qualify for replacement or refund.

15. Educational Content and No Medical Claims

Veld-Leaf may provide educational content relating to lifestyle, wellness, responsible use, cannabis education, plant knowledge, accessories and related topics. All content is provided for general educational and informational purposes only.
Veld-Leaf does not claim that any item, content, selection, recommendation, category or service will diagnose, treat, cure, prevent or manage any disease, condition, symptom, disorder or medical concern.
Nothing on the website constitutes medical advice, legal advice, pharmaceutical advice, psychological advice or professional healthcare advice. Members should consult an appropriately qualified healthcare professional before making decisions that may affect their health.

• are pregnant or breastfeeding;
• have a medical condition;
• use prescription medication;
• have a history of mental health concerns;
• are sensitive to cannabis, THC, CBD, smoke, vapour, oils or related substances; or
• are unsure whether any item or practice is suitable for them.

16. ANHA Practitioner Disclosure

Where educational content is provided by, associated with or informed by an ANHA-registered practitioner, that professional status does not automatically create a practitioner-patient relationship through the website.
Participation in the Veld-Leaf sponsorship programme is separate from any professional consultation, assessment, treatment, diagnosis, practitioner service or therapeutic engagement.
Any professional consultation, where offered, must be booked, agreed to, documented and handled separately under the applicable professional framework and informed consent process.

17. Responsible Use and Risk Acknowledgement

Members acknowledge that certain items may carry personal, health, legal, employment, travel, safety or impairment risks. Members accept responsibility for responsible, private and lawful use after delivery or collection.
Members must not use any item in a way that may endanger themselves, others, minors, road users, employees, employers, property owners, Veld-Leaf or the public.

18. Privacy and Personal Information

Veld-Leaf respects privacy and will process personal information in accordance with the Protection of Personal Information Act, 4 of 2013, where applicable.
Veld-Leaf may collect and process personal information for purposes including profile creation, age verification, payment processing, delivery, customer support, legal compliance, fraud prevention, marketing communication where consent is given, record-keeping and operational administration.
Veld-Leaf may share necessary personal information with service providers such as payment processors, couriers, website providers, compliance advisors, accountants, legal representatives, insurers or regulators where required for legitimate business purposes or legal compliance.
Veld-Leaf will take reasonable steps to protect personal information from unauthorised access, loss, misuse, alteration or disclosure. Members may request access to, correction of or deletion of their personal information, subject to legal retention requirements.

19. Marketing Communications

By creating a profile or participating in the sponsorship programme, Members may be asked whether they wish to receive marketing communication from Veld-Leaf. Members may unsubscribe from marketing communication at any time.
Veld-Leaf will not sell personal information to third-party advertisers.

20. Intellectual Property

All Veld-Leaf content, including the Veld-Leaf name, brand identity, category names, text, graphics, product descriptions, images, designs, layouts, documents, templates, wording and related materials, belongs to Veld-Leaf or its authorised licensors.
Members may not copy, reproduce, distribute, modify, exploit, imitate or use any Veld-Leaf intellectual property without prior written consent.

21. Website Security and Availability

Veld-Leaf does not guarantee that the website will always be available, uninterrupted, error-free or free from technical issues. Veld-Leaf may suspend or restrict the website for maintenance, upgrades, security reasons, operational requirements, legal compliance or system protection.
Members may not misuse the website by introducing viruses, attempting unauthorised access, interfering with platform functionality, copying content, scraping data or using the website in any manner that may harm Veld-Leaf or other users.

22. Limitation of Liability

To the maximum extent permitted by law, Veld-Leaf will not be liable for indirect, incidental, special, consequential or punitive damages, including loss of profits, loss of opportunity, reputational harm, loss of data, business interruption, third-party claims or losses arising from Member misuse, unlawful conduct or circumstances beyond Veld-Leaf’s reasonable control.
Nothing in these Terms excludes liability where such exclusion is prohibited by law. Where Veld-Leaf is found liable, its liability will be limited, to the extent permitted by law, to the value of the relevant sponsorship contribution or Preference Item giving rise to the claim.

23. Indemnity

Members agree to indemnify and hold Veld-Leaf, its directors, employees, representatives, suppliers, contractors and service providers harmless against any claim, loss, damage, penalty, liability, cost or expense arising from:

• breach of these Terms;
• false or incomplete information supplied by the Member;
• unlawful use of the website or preference system;
• unlawful possession, use, supply, resale or redistribution of any item;
• failure to comply with age restrictions;
• misuse of any Preference Item;
• breach of applicable law; or
• any claim brought by a third party because of the Member’s conduct.

24. Suspension and Termination

Veld-Leaf may suspend, restrict or terminate access to the website or sponsorship programme if it reasonably believes that a Member has breached these Terms, provided false information, failed verification, misused the platform, acted unlawfully, abused the preference system, attempted resale or redistribution, or created risk for Veld-Leaf or others.

25. Force Majeure

Veld-Leaf will not be responsible for delay or failure to perform caused by events beyond its reasonable control, including courier disruption, supplier failure, stock shortages, power outages, strikes, regulatory changes, natural disasters, system failures, payment-provider issues, government action, civil unrest, pandemics or other force majeure events.

26. Compliance Changes

Laws, regulations, payment-provider rules, courier policies and supplier requirements may change. Veld-Leaf reserves the right to amend, suspend, restrict or discontinue any part of the website, sponsorship programme, product category, preference selection, delivery method or website content where necessary to comply with law, legal advice, operational risk or third-party requirements.

27. Complaints and Dispute Resolution

Members are encouraged to contact Veld-Leaf first so that any issue can be resolved directly. Complaints must be submitted in writing to Orders@veld-leaf.co.za. Veld-Leaf will endeavour to respond within a reasonable period.
If a dispute cannot be resolved internally, the parties may consider mediation before approaching a court or relevant authority, unless urgent legal action is required.

28. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any dispute arising from these Terms, the website, sponsorship programme, preference selection process, delivery or related services will be handled under South African law.

29. Amendments

Veld-Leaf may update these Terms from time to time. The latest version will be published on the website and will apply from the date of publication unless otherwise stated. Continued use of the website after changes are published means the Member accepts the updated Terms.

30. Entire Agreement

These Terms, together with the Privacy Policy, Disclaimer, Returns Policy, Delivery Policy and any written agreement between Veld-Leaf and the Member, form the entire agreement between the parties regarding use of the website and participation in the sponsorship programme.

31. Member Acknowledgement

By using the Veld-Leaf website, making a sponsorship contribution or submitting a preference selection, the Member confirms that:

• the Member is 18 years or older;
• the Member has read, understood and accepted these Terms;
• the information provided by the Member is accurate;
• the Member will participate lawfully, privately and responsibly;
• the Member understands that preference selections are subject to availability, verification and legal compliance; and
• the Member accepts responsibility for their own conduct after delivery or collection.
